Disclosure of Certain Relationships

Conflict of Interest Questionnaire
Effective January 1, 2006, Chapter 176 of the Texas Local Government Code requires that any vendor or person who contracts or seeks to contract, with a local government entity make certain disclosures concerning any affiliation or business relationship that might cause a conflict of interest with the local governmental entity. The provisions of Chapter 176 and Form CIQ questionnaire that you must complete to comply with this new law are available at the Texas Ethics Commission website.

Local Government Officer Conflicts Disclosure Statement 

A current list of Tom Green County Officers is available in the Office of the County Clerk, 124 W. Beauregard Ave, San Angelo, TX 76903. If you are considering doing business with Tom Green County and have an affiliation or business relationship that requires you to submit a completed Form CIQ, it must be filed with the records administrator (County Clerk) of Tom Green County not later than the 7th business day after the date you become aware of the facts that require the form to be filed. See section 176.006, Texas Local Government Code. It is a Class C misdemeanor to violate this provision.

By submitting a response to Tom Green County for Request For Bids, Requests For Proposals, or Requests For Statements of Qualifications or by conducting business with Tom Green County, you are representing that you are in compliance with the requirements of Chapter 176 of the Texas Local Government Code.

Form 1295
In 2015, the Texas Legislature adopted House Bill 1295, which added section 2252.908 of the Government Code. The law states that a governmental entity or state agency may not enter into certain contracts with a business entity unless the business entity submits a disclosure of interested parties to the governmental entity or state agency at the time the business entity submits the signed contract to the governmental entity or state agency. The law applies only to a contract of a governmental entity or state agency that either (1) requires an action or vote by the governing body of the entity or agency before the contract may be signed or (2) has a value of at least $1 million. The disclosure requirement applies to a contract entered into on or after January 1, 2016. The Texas Ethics Commission was required to adopt rules necessary to implement that law, prescribe the disclosure of interested parties form, and post a copy of the form on the commission’s website. The commission adopted the Certificate of Interested Parties form (Form 1295) on October 5, 2015.
